The Leasehold & Freehold Reform Act 2024

The battle is not over yet. Freeholders are still appealing. The current act only allows:

  • Extra 990 years rather than the current 90 years. 
  • 2 year ownership rule removed.
  • The freeholders will have to pay their own costs.
  • You will be able to buy out a high or escalating ground rent liability at a reduced capped rate.

The is still no agreement on:

  • No marriage value payable for flats with under 80 years remaining at the date of the claim.
  • The government will set deferment & capitalisation rates which may or may not increase the cost of your lease extension under the 2024 Act.

REASONS TO EXTEND YOUR LEASE

  • Leases below 100 years remaining are more difficult to sell and re-mortgage

  • Leases below 80 years may not be accepted by mortgage lenders and only attract cash buyers.

  • Leases with high and escalating ground rent liability will reduce the value of your flat.
