  1. Scope of These Terms

These Terms and Conditions govern your use of our website and provide general information about the basis on which our services are offered.

Additional terms may apply to individual instructions, including a quotation, letter of engagement or other written agreement. Where those documents contain specific terms for an instructed service, they should be read alongside these Terms and Conditions. Any agreed terms specific to an instruction will take precedence to the extent of any inconsistency.

Please contact us if you have any questions before instructing us.

  1. Website Information

We endeavour to ensure that information on our website is accurate and up to date. However, information is provided for general guidance and may change as legislation, professional guidance, market conditions and industry practices develop.

Although we take reasonable care when preparing our website content, we cannot guarantee that all information will be complete, current or suitable for every individual circumstance.

  1. Our Services

Capital Leasehold provides specialist services that may include:

  • Lease extension desktop appraisals.
  • Inspection-based lease extension reports.
  • Lease extension advice in connection with statutory lease extensions, including Section 42 claims.
  • Negotiations with freeholders and their appointed surveyors.
  • Advice concerning residential lease extensions and collective enfranchisement, where agreed.

The precise scope of any service will be confirmed in the relevant quotation or engagement documentation.

A desktop appraisal is based on information available remotely and is not the same as a full inspection-based report. The appropriate service will depend on the property, the lease, the purpose of the report and the circumstances of the proposed transaction.

  1. Quotations and Instructions

Requests submitted through our website, email or telephone do not automatically constitute an instruction to undertake professional work.

A quotation will specify the proposed service and, where applicable, the fee, VAT, scope of work, assumptions and any exclusions.

An instruction will normally be accepted when we have confirmed acceptance in writing and any agreed initial requirements have been satisfied.

You should not assume that work has commenced until we have confirmed your instruction.

  1. Fees and Payment

Our fees will be communicated in the relevant quotation or engagement documentation.

Unless otherwise agreed in writing:

  • Fees are payable in accordance with the payment terms confirmed when you instruct us.
  • VAT will be charged where applicable.
  • Any additional work outside the agreed scope may incur an additional fee, which will be explained and agreed with you where appropriate.
  • Third-party expenses or disbursements will be identified where relevant.
  • Any applicable cancellation, termination or refund arrangements will be set out in the agreed terms for the service.

If payment is overdue, we may take appropriate steps to recover outstanding amounts in accordance with our agreement with you and applicable law.

  1. Client Responsibilities

To enable us to provide an appropriate service, you agree to:

  • Provide accurate and complete information about the property and lease.
  • Supply relevant documents when reasonably requested, including the lease, ground rent details and property information.
  • Inform us of any known matters that could affect the lease extension.
  • Respond promptly to reasonable requests for information.
  • Inform us of any relevant deadlines, notices or correspondence received from the freeholder or their representatives.
  • Pay agreed fees in accordance with the applicable terms.

We cannot accept responsibility for the consequences of inaccurate, incomplete or misleading information supplied to us, except to the extent that liability cannot lawfully be excluded or limited.

  1. Reports and Appraisals

Our reports and appraisals are prepared for the purpose and scope agreed with the client.

A lease extension premium may depend on several factors, including the property’s value, the unexpired lease term, ground rent provisions, relevant assumptions and the legislation applicable to the claim.

Any desktop appraisal or preliminary estimate is based on the information available at the time. It should not be treated as a guaranteed final premium or as a substitute for a formal report where one is required.

Opinions reflect professional judgement and the relevant evidence and assumptions available at the  date. Different professional opinions may arise from differences in evidence, assumptions or interpretation.

You should not rely on a formal report for a purpose outside its agreed scope without obtaining our written confirmation.

  1. Negotiations with Freeholders

Where instructed to negotiate on your behalf, we will act within the scope of our engagement and exercise reasonable professional care.

We cannot guarantee that negotiations will result in a particular premium, settlement, timescale or outcome.

Any settlement, offer or material decision requiring your approval will be referred to you in accordance with the agreed scope of our instruction.

Unless expressly agreed in writing, our services do not include legal representation, legal advice or the conduct of legal proceedings. You may need to appoint a solicitor to deal with the legal aspects of your lease extension.

  1. Timescales and Statutory Deadlines

We will use reasonable endeavours to carry out agreed work within the timescales communicated to you.

Timescales may be affected by the availability of information, the complexity of the property, third-party responses and other circumstances outside our control.

You must tell us about any statutory deadlines or time-sensitive notices relevant to your instruction. We do not assume responsibility for a deadline unless the relevant responsibility has been expressly agreed in writing.

You should seek appropriate legal advice concerning the service of notices, statutory procedures and the legal consequences of missing a deadline.

  1. Professional Standards

Our surveying services are provided by appropriately qualified professionals in accordance with the professional standards and regulatory requirements applicable to the work undertaken.

Where a service is provided by an RICS-regulated professional or Registered Valuer, the applicable professional requirements will be observed.

Information about the relevant professional’s qualifications and regulatory status can be requested from us.

  1. Intellectual Property

Unless otherwise stated, the content on this website, including text, graphics, branding and other materials, is owned by or licensed to Capital Leasehold.

You may view and print reasonable extracts for your personal, non-commercial use. You must not reproduce, distribute, modify or commercially exploit website content without our prior written permission, except where permitted by law.

Reports, appraisals and other professional documents prepared for a client are subject to the ownership, copyright, permitted-use and reliance provisions specified in the relevant engagement documentation.

  1. Website Availability and Security

We do not guarantee uninterrupted website availability or that the website will always be free from errors, viruses or other harmful components.

You are responsible for using appropriate security measures when accessing the website.

You must not misuse the website, attempt to gain unauthorised access to its systems or interfere with its operation.

  1. Liability

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

This includes liability for fraud or fraudulent misrepresentation, and any liability that cannot lawfully be excluded or restricted.

Any exclusions, limitations or caps applying to our professional services will be set out in the relevant engagement documentation and will be subject to applicable law and professional requirements.

We do not accept responsibility for decisions made solely on the basis of general website content where that content was not prepared as professional advice for your particular circumstances.

  1. Third-Party Websites

Our website may contain links to external websites for convenience or information.

  1. Privacy and Cookies

Our collection and use of personal information are explained in our Privacy Policy.

Our use of cookies and similar technologies is explained in our Cookie Policy.

These policies should be read alongside these Terms and Conditions.

  1. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our services, website or applicable requirements.

The latest version will be published on our website with the relevant update date.

Changes will not retrospectively alter an existing engagement where doing so would conflict with the terms already agreed or applicable law.

  1. Governing Law

These Terms and Conditions, and any non-contractual obligations arising in connection with them, are governed by the laws of England and Wales, subject to any mandatory legal rights that apply.

The courts of England and Wales will have jurisdiction where legally appropriate.
